OUR FEES & COMMISSIONS FOR RSVP SERVICES

To maintain the proper functioning of the platform, cover the costs of our services and maintain our users’ attention uninterrupted, we charge certain commissions when the reservation is paid, in accordance with our modalities.

RESERVATION FEES FOR SPACES AND SERVICES 

  • Share the commission between Users and Suppliers:

A shared fee would be charged between Users and Suppliers. A fixed 6.00% would be deducted from the Provider, as promotion for limited time (regular comission 12.00%). A 6.00% – 8.00% would be charged for most Users. This amount is calculated from the reservation subtotal (the reservation fee for the space or service, additional services fee, cleaning fee and others).

The rate range would vary based on date change and cancellation policies. Please see below.

FEES ADJUSTMENTS DUE TO FLEXIBILITY

The applicable rates will be adjusted to the Users depending on the flexibility of the Suppliers, being 6.00% the most flexible and 8.00% the least flexible. The rates according to flexibility are as follows:

    • Flexible Provider: A 6.00% would be charged to the User
    • Moderate Provider: A 7.00% would be charged to the User
    • Strict Provider: a 8.00% would be charged to the User

APPLICABLE CONDITIONS

We reserve the right to modify, adjust or include our rates, always respecting the conditions of the transactions in progress or prior to the change.

Pursuant to the provisions applicable in the Republic of Panama, the Transfer of Personal Property and Services Tax (I.T.B.M.S.) could be charged in addition to the service rates for Users and suppliers. This tax will be included on the service fee when applicable.

CANCELLATION POLICIES

USERS CANCELLATIONS

Users who have reserved a Space or Service may cancel their reservation in accordance with the following terms and based on the cancellation policy of the Space or Service Provider.

1. Reserve Commission. The Cancellation Policy applies to all Users without prejudice to the type of reservation fee to which the User is subject in accordance with the Rate Policies.

2. Cancellation Notifications. The User must submit the cancellation request through the RSVP Platform. Your cancellation is not effective until you have completed and completed the cancellation process through the platform. The process will consist of:

1. Request the Provider, through the Platform Chat, to cancel the event in applicable time.
2. The Provider will approve the cancellation and will coordinate with the RSVP team to proceed with the refund of the reservation.
3. A member of the RSVP team will contact the User to make the refund. Commissions charged by the RSVP Platform are non-refundable and bank charges would apply.

3. Cancellation Policies. We allow Suppliers to choose one of the following options within our cancellation policies, which must be visible in the description of the Space or Service exhibited:

  • Flexible Provider: Cancellations can be made by the User within 2 calendar days of the date on which they will receive the Service or use the Space. The Provider through the RSVP Platform will reimburse the total amount corresponding to the booked Space and / or Service provided that the cancellation is made within the stipulated time, except for the RSVP reservation fee, which is not refundable. Bank charges and other applicable charges apply.Also, on sole discretion of the Provider, service might be rescheduled.
  • Moderate Provider: Cancellations can be made by the User within 4 calendar days before the date on which they will receive the Service or use the Space. The Provider through the RSVP Platform will reimburse the total amount corresponding to the  Space and / or Service booked, provided that the cancellation is made within the stipulated time, except for the RSVP reservation fee, which is not refundable. Bank charges and other applicable charges apply.Also, on sole discretion of the Provider, service might be rescheduled.
  • Strict Provider: Cancellations can be made by the User within 1 week before the date on which they will receive the Service or use the Space. The Provider through the RSVP Platform will reimburse the total amount corresponding to the Space AND / or Service booked, provided that the cancellation is made within the stipulated time, except for the RSVP reservation fee, which is not refundable. Bank charges and other applicable charges apply.Also, on sole discretion of the Provider, service might be rescheduled.
  • Conservative Provider: The User can make cancellations within 15 days before the date on which he/she will receive the Service or use the Space. The Provider through the RSVP Platform will reimburse 50% of the total amount corresponding to the Space and/or Service booked, provided that the cancellation is made within the stipulated time, with the exception of the RSVP reservation fee, which is not refundable. Bank charges and other applicable fees apply.Also, on sole discretion of the Provider, service might be rescheduled.
  • Non-Cancellation Provider: Considering the kind of service the Provider is rendering; Cancellations are not allowed for Users. The Provider is not obliged to reimburse the total or partial amount corresponding to the Space and/or Service booked. Provider in case by case situation and on its own discretion, prior to the rendering of the service, might reimburse a percentage (%) of the total amount corresponding to the Space and/or Service booked with the exception of the RSVP reservation fee, which is not refundable. Bank charges and other applicable fees apply. Also, on sole discretion of the Provider, service might be rescheduled.

4. Stipulation of Payment Time: The Supplier will stipulate in the display of the Service or Space, the time that the User would have to make the payment to complete the reservation. After this time, the reservation will be considered canceled without the need for a refund.

The User will not be entitled to any refund regarding cancellations made if it is not carried out in accordance with the modality chosen by the Supplier and in accordance with these cancellation policies.

SPACES AND SERVICES SUPPLIERS CANCELLATIONS

The Providers of spaces and services may cancel a reservation of their space or service in accordance with the following terms:

1. Reserve Commission. The Cancellation Policy applies to all Providers without prejudice to the type of reservation fee to which the Provider is subject, in accordance with the Fee Policies and the collection of any other applicable fee. The commission we charge to Suppliers is non-refundable.

2. Cancellation Notifications. The Supplier must submit the cancellation request through the RSVP Platform. Your cancellation is not effective until you have completed and completed the cancellation process through the platform. The process will consist of:

1. Notify about the cancellation through the Platform chat to the User who has reserved the space and / or service.
2. The Supplier shall coordinate with the RSVP team to proceed with the applicable refund.
3. A member of the RSVP team will contact the User to coordinate the refund.

3. Cancellation Commission. The Provider who cancels a reservation less than 30 calendar days prior to the date on which the User will receive the Service or use the Space, will be charged a fee of US $ 100.00 in addition to the amount of the reservation commission paid by the User, bank charges and other applicable charges. The Supplier may cancel a reservation for every six months. Any cancellation or reservation fee applicable to the Supplier will be deducted from the amount corresponding to the next withdrawal of funds from the platform.

4. Discretion of RSVP. We reserve the right and full discretion to suspend or cancel at any time and without further formalities or notifications, accounts to Suppliers that do not comply with cancellation policies.

EXCUSED CANCELLATIONS

RSVP allows the Providers of Spaces and / or Services to cancel the reservation in the short term due to extenuating and extraordinary circumstances.

1. Cancellation Notifications. You must submit the cancellation request through the RSVP Platform. The excused cancellation must be presented by the Provider for the approval of our RSVP team. A member of our team will evaluate the request and applicability of the cancellation and may request evidence to support the excused cancellation.

If the excused cancellation is granted, a member of our team will contact the User to make the refund in full and may apply bank charges and other applicable charges.

The following circumstances will be considered in our total and exclusive discretion, as reasons for excused cancellations:

a. Unexpected death or serious illness of the User, Provider or direct family member of either of the two;
b. Serious injury that prevents the User from moving or the Supplier the possibility of providing the reserved Space or Service.
c. In the event that a state of emergency is declared by the relevant government entity and that directly prevents the use of the Space or the provision of the Service by the Suppliers.
d. Urgent mobilization restriction issued after the reservation, by the authorized government entity;
e. Court, government or municipal order that prevents the use of the Space or the Provision of the Service.
f. For reasons of wars, government acts, force majeure or acts of God.

RSVP CANCELLATIONS

RSVP may consider necessary, in its total and exclusive discretion, the cancellation of a reservation with any time in advance of the provision of the Service or the Use of the Space. When RSVP cancels the reservation, unless it is attributable to actions by the User, it will make a full refund to the User and will not transfer the funds resulting from the reservation to the Supplier, being able to reserve the right to retain the reservation commission. In the event that the User performs an act of misconduct, the refund will be made in accordance with the applicable cancellation policies and the intention to cancel will be understood as notified.

Neither RSVP, Users nor Suppliers will have civil or commercial obligations due to the cancellation made by RSVP. Below are the reasons why RSVP may initiate cancellation at its discretion:

a. If RSVP in its sole and absolute discretion considers that the conduct of the User or the event for which the Supplier was contracted may violate local laws, or may carry a risk of security or property, or may violate the policies, terms and conditions of the platform, RSVP may cancel due to User misconduct.
b. An Excused Cancellation;
c. Removal of the Space or Service from the platform prior to the date on which the User will receive the Service or use the Space;
d. Watering damage or security issues;
e. Lack of presentation of permits, licenses, insurance necessary for the development of the event at the request of RSVP;
f. Any other reason.

DISPUTE RESOLUTION

Any conflict derived by reason of the Cancellation Policies and Rate Policies will be subject to the applicable regulations of the Republic of Panama, with the Panamanian judicial courts being competent to deal with such matters.
